Website, Reservation, SMS, and Chauffeured Transportation Terms

These Terms apply to Dad-Fu-Sa’s website, booking tools, mobile or web applications, telephone and text reservations, and chauffeured transportation services. A booking confirmation may contain service-specific terms that supplement these Terms.

1. Acceptance and Scope

These Terms and Conditions (the “Terms”) form a binding agreement between you and Dad-Fu-Sa Chauffeur Services Inc. (“Dad-Fu-Sa,” “we,” “us,” or “our”). By accessing our website, creating an account, requesting a quote, making or accepting a reservation, receiving text messages related to a reservation, or using our transportation services (collectively, the “Services”), you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services. If you use the Services on behalf of a company, travel arranger, passenger, or other organization, you represent that you are authorized to bind that person or organization and to provide the passenger information submitted with the reservation.

Service-specific information displayed in a quote, rate sheet, reservation confirmation, corporate agreement, event agreement, or written special-event notice is incorporated into these Terms. If there is a direct conflict, the more specific written term controls for that reservation.

2. Eligibility and Passenger Responsibility

You must be at least 18 years old and legally able to enter into a contract to book Services. A parent, legal guardian, employer, or authorized arranger may book for another passenger and is responsible for communicating these Terms and all ride instructions to that passenger.

You are responsible for providing accurate and complete information, including passenger name, mobile number, pickup and destination addresses, date and time, flight or train number, passenger count, luggage, accessibility needs, requested child restraints, and any other information reasonably necessary to safely perform the ride.

3. Quotes, Reservations, and Confirmations

A quote or website estimate is not a confirmed reservation. A reservation is accepted only when Dad-Fu-Sa issues a confirmation by email, text message, app notification, or other written communication. Services remain subject to vehicle, chauffeur, affiliate, and route availability.

You must review the confirmation promptly and notify us of any error. Dad-Fu-Sa is not responsible for an error caused by inaccurate, incomplete, or late information supplied by you, a passenger, an arranger, an airline, a travel agency, or another third party.

Changes requested after confirmation are subject to availability and may change the price. A material change to the pickup time, pickup location, destination, vehicle class, passenger count, service duration, or route may be treated as a new reservation.

4. Vehicles, Chauffeurs, and Service Partners

Vehicle photographs and descriptions are examples of a vehicle class, not a guarantee of a particular make, model, year, color, feature, or chauffeur. We may provide a comparable or higher vehicle class without additional charge when reasonably necessary.

Dad-Fu-Sa may perform a ride directly or engage a properly authorized affiliate, independent transportation provider, or subcontractor. We may share the reservation information reasonably needed to perform the ride. Any provider-specific rules disclosed before service may also apply, but they will not reduce rights that cannot legally be waived.

We may refuse, suspend, or cancel a reservation when performance would be unsafe, unlawful, operationally impracticable, or inconsistent with these Terms.

5. Pricing and Additional Charges

The estimated or fixed base price appears in the quote or confirmation. “No surge pricing” means that Dad-Fu-Sa does not dynamically raise a confirmed base rate solely because demand is high. It does not eliminate charges triggered by the customer’s changes, actual use, or third-party costs.

Unless expressly included in the confirmation, the final charge may include applicable taxes, tolls, parking, airport or facility fees, fuel or regulatory surcharges, meet-and-greet charges, gratuity disclosed at booking, waiting time, extra stops, route or destination changes, overtime, excess distance, cleaning, repairs, and other authorized or reasonably incurred charges.

Rates for hourly service may include a minimum number of hours and mileage limits. Service beyond the booked time or mileage may be billed in the increments and at the rates shown in the confirmation or current rate schedule. Shortening the ride after dispatch does not necessarily reduce a minimum charge.

6. Payment Authorization and Billing

You must provide a valid payment method unless Dad-Fu-Sa has approved another billing arrangement. By providing payment information, you authorize Dad-Fu-Sa and its payment processors to obtain a preauthorization, charge the estimated amount, and charge the final amount and any later-discovered authorized adjustments under these Terms.

A preauthorization is a temporary hold and may appear separately from the final charge. The timing of release is controlled by your financial institution. Dad-Fu-Sa does not control bank processing times.

You agree to contact us promptly about a billing concern before initiating a chargeback. This does not limit any rights available under applicable payment-card law. Undisputed past-due amounts may be subject to reasonable collection costs and legally permitted fees.

7. Cancellations, Changes, and No-Shows

Unless the confirmation states a different policy, a sedan or SUV reservation may be canceled without a service charge at least three (3) hours before the scheduled pickup time. Larger vehicles, hourly minimums, special events, holidays, long-distance trips, and reservations requiring dedicated positioning may have longer or nonrefundable cancellation terms stated in the confirmation.

A cancellation or material reduction within the applicable cancellation window may be charged up to the full estimated fare, including any disclosed minimum, committed third-party cost, and gratuity or service charge identified in the confirmation.

A reservation may be treated as a no-show if the passenger cannot be located or contacted within sixty (60) minutes after the tracked arrival time for an airport or train-station pickup, or within thirty (30) minutes after the scheduled time for another pickup. If no valid flight or train information was supplied, the scheduled pickup time controls. A no-show may be charged up to the full estimated fare and incurred fees.

If you cannot locate the chauffeur, you must call or text Dad-Fu-Sa before leaving the pickup location. Leaving without contacting us may result in a no-show charge.

A cancellation is effective only when received through the method identified in the confirmation, the booking portal, or by confirmed telephone or text communication with Dad-Fu-Sa. Cancel each segment of a multi-ride itinerary separately.

8. Waiting Time, Flight Tracking, and Delays

Unless the confirmation states otherwise, the base rate includes up to sixty (60) minutes of waiting after the tracked arrival time for a commercial airport or train pickup and up to fifteen (15) minutes after the scheduled time for other pickups. Additional waiting time may be billed in fifteen-minute increments or under the applicable hourly rate.

Flight and train tracking is a convenience and is not guaranteed to be accurate or available. You remain responsible for giving us the correct flight or train number and promptly communicating diversions, cancellations, terminal changes, missed connections, or unusually long customs, baggage, or security delays.

Pickup and arrival times are estimates affected by traffic, weather, road conditions, security restrictions, construction, law-enforcement activity, and other conditions outside our control. You should schedule airport transportation with adequate time. We do not guarantee that a passenger will make a flight, appointment, or connection.

9. Passengers, Luggage, Accessibility, Children, and Animals

The number of passengers and amount of luggage must not exceed the safe and legal capacity of the vehicle. Oversized, unusually heavy, hazardous, fragile, or high-value items must be disclosed before confirmation. The chauffeur may refuse items that cannot be transported safely or lawfully.

Dad-Fu-Sa will provide reasonable assistance and will accommodate service animals as required by applicable law. Passengers should disclose mobility devices, transfer needs, or other accommodations early enough for appropriate planning. An accessibility request will not be used to deny lawful service.

The person booking is responsible for requesting any legally required child restraint and confirming availability. If Dad-Fu-Sa does not expressly confirm that a suitable restraint will be supplied, the responsible adult must provide and install an appropriate restraint. We may decline to transport an unaccompanied minor or a child for whom legally required safety arrangements have not been made.

Non-service animals require advance approval and may need to be secured in an appropriate carrier. Additional cleaning or vehicle restrictions may apply.

10. Passenger Conduct and Safety

Passengers must follow applicable law, wear seat belts, remain seated when required, and follow reasonable chauffeur instructions related to safety and vehicle operation.

Smoking, vaping, illegal drug use, harassment, threats, violence, dangerous conduct, intentional distraction of the chauffeur, opening doors while moving, exceeding capacity, or damaging the vehicle is prohibited. Alcohol may be carried or consumed only when lawful, permitted by the vehicle operator, and consistent with all open-container and passenger-safety laws.

The chauffeur may refuse to begin or may terminate a ride when a passenger’s condition, conduct, cargo, or requested route presents a safety or legal risk. In that situation, the fare may remain due and no refund is required to the extent permitted by law.

11. Damage, Cleaning, and Lost Property

The booking customer is responsible for reasonable cleaning, repair, replacement, towing, biohazard remediation, and documented loss-of-use costs caused by the customer or anyone in the customer’s party, excluding ordinary wear and damage caused by Dad-Fu-Sa or the provider.

Inspect the vehicle and report a damage concern as soon as reasonably possible. We may charge the payment method on file after providing a description of the charge and, when reasonably available, supporting documentation.

Dad-Fu-Sa is not an insurer of property left in a vehicle. We will make reasonable efforts to locate and return found items, but we do not guarantee recovery. The owner is responsible for shipping, delivery, storage, or special handling costs. Unclaimed property may be disposed of or delivered to authorities after a reasonable period.

12. Service Interruptions and Force Majeure

Dad-Fu-Sa is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, unsafe roads, traffic incidents, road closures, public emergencies, strikes, civil disorder, acts of government, airport restrictions, communications outages, cyber incidents, supply shortages, or sudden mechanical failure despite reasonable maintenance.

When a confirmed vehicle becomes unavailable, we may arrange a substitute vehicle or provider. If we cancel and cannot provide a reasonable substitute, our ordinary contractual remedy will be a refund of the prepaid amount for the unperformed portion of the affected service. This section does not limit liability that cannot legally be limited.

13. Accounts, Website, and Application Use

You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly of unauthorized access.

You may use the website and booking tools only for lawful, personal, business-travel, or authorized arranging purposes. You may not interfere with security, introduce malicious code, scrape or harvest data, overload the Services, impersonate another person, reverse engineer an application except where law expressly permits it, or use the Services to develop a competing database or booking product.

We may suspend access, remove content, or terminate an account when reasonably necessary to protect passengers, chauffeurs, Dad-Fu-Sa, service providers, or the integrity of the Services.

14. Intellectual Property and Feedback

The website, applications, branding, text, graphics, photographs, software, and other content are owned by Dad-Fu-Sa or its licensors and are protected by intellectual-property law. We grant you a limited, revocable, nonexclusive, nontransferable right to use the Services for their intended purpose.

If you voluntarily provide a review, suggestion, photograph, or other feedback, you grant Dad-Fu-Sa a nonexclusive, worldwide, royalty-free license to use it for service improvement and lawful promotional purposes, subject to our Privacy Policy and any restrictions you communicate and we accept in writing. Do not submit content you do not have the right to share.

15. Third-Party Services

The Services may rely on third-party booking, dispatch, mapping, communications, analytics, payment, app-store, or affiliate transportation services. Third parties may have their own terms and privacy notices. Dad-Fu-Sa is not responsible for a third party’s independent website, application, or conduct, but this does not eliminate responsibility imposed on us by law for vendors acting on our behalf.

16. Telephone and SMS Terms

By providing a mobile number or texting Dad-Fu-Sa, you consent to receive reservation-related calls and text messages, including booking confirmations, pickup instructions, chauffeur updates, receipts, and customer-service messages. Messages may be sent using automated technology where permitted. Message frequency varies with your reservations, and message and data rates may apply.

Reply STOP to an eligible message to opt out of SMS messages and HELP for assistance, or contact us using the details below. We will honor legally valid revocation requests within the period required by law. Opting out of texts does not cancel a reservation, and you may need to provide another reliable communication method.

Marketing texts, if offered, require the consent required by law and are not a condition of purchasing transportation. Dad-Fu-Sa does not share a mobile number or SMS consent record with third parties for their own marketing. We may share it with communications vendors that send messages for us and with transportation providers as needed to perform a ride.

17. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Services, you acknowledge the practices described in that policy. You are responsible for having authority to provide personal information about another passenger.

18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, BOOKING TOOLS, AND NON-TRANSPORTATION DIGITAL FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DAD-FU-SA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY BE DISCLAIMED.

WE DO NOT WARRANT THAT DIGITAL SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NOTHING IN THESE TERMS DISCLAIMS AN EXPRESS WRITTEN COMMITMENT IN A CONFIRMATION OR A WARRANTY OR CONSUMER RIGHT THAT CANNOT LEGALLY BE DISCLAIMED.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAD-FU-SA AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR MISSED OPPORTUNITIES, ARISING FROM THE DIGITAL SERVICES OR A DELAY, EXCEPT WHERE SUCH A LIMITATION IS PROHIBITED.

FOR A CLAIM RELATING ONLY TO THE WEBSITE, APPLICATION, BOOKING ADMINISTRATION, BILLING ADMINISTRATION, OR OTHER NON-BODILY-INJURY MATTER, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT PAID FOR THE AFFECTED RESERVATION OR ONE HUNDRED U.S. DOLLARS ($100), TO THE EXTENT PERMITTED BY LAW.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE IT CANNOT BE LIMITED, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, A VEHICLE OPERATOR’S LEGALLY REQUIRED INSURANCE OBLIGATIONS, OR ANY OTHER LIABILITY THAT LAW DOES NOT ALLOW US TO LIMIT.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dad-Fu-Sa and its personnel from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, information you were not authorized to provide, or injury or property damage caused by you or your party. This obligation does not apply to the extent a claim results from Dad-Fu-Sa’s negligence, gross negligence, or willful misconduct.

21. Governing Law and Dispute Resolution

Before filing a lawsuit, the complaining party should send written notice describing the dispute and requested resolution and allow thirty (30) days for a good-faith attempt to resolve it. This informal process does not prevent a party from seeking emergency relief or meeting a legal filing deadline.

These Terms are governed by Michigan law, without regard to conflict-of-law principles. Except where applicable law permits or requires another forum, the state and federal courts located in or serving Oakland County, Michigan will have exclusive jurisdiction, and each party consents to that venue.

Nothing in this section limits a consumer’s non-waivable right to bring an eligible claim in small-claims court or to contact a regulator or law-enforcement agency.

22. Changes to These Terms

We may update these Terms to reflect changes in our Services, operations, or law. The “Effective date” will show the latest revision. Material changes will be communicated by a reasonably prominent notice or other method required by law. The Terms in effect when a reservation is confirmed generally govern that reservation unless a change is required by law or you agree otherwise.

23. General Provisions

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or transfer of the business, subject to applicable law.

These Terms, the Privacy Policy, the reservation confirmation, and any signed corporate or event agreement constitute the entire agreement regarding the covered subject matter and supersede prior oral or written statements on that subject.
